After an arrest in Harris County

What to do when someone you love is arrested

The first hours after an arrest move fast. These steps protect the person in custody and their case.

DWI arrest? Watch the 15 day deadline. After a DWI arrest in Texas, you generally have 15 days from receiving the notice of suspension to request an administrative license revocation hearing (Tex. Transp. Code §524.031). Miss it and the suspension can take effect automatically.
  1. Find where they are being heldUse the Harris County Sheriff's Office inmate search, or the sheriff's search in Fort Bend, Montgomery or the county where the arrest happened.
  2. Expect a magistrate hearingTexas law requires an arrested person to be brought before a magistrate, generally within 48 hours, where rights are explained and bail is often set (Tex. Code Crim. Proc. art. 15.17).
  3. Do not discuss the case on jail callsJail phone calls and video visits are recorded and can be used as evidence. Talk only about logistics.
  4. Use the right to remain silentAnyone in custody can decline to answer questions and ask for a lawyer. Politely saying "I want a lawyer" is enough.
  5. Gather the paperworkWrite down the booking number, charges, bond amount and any court date. An attorney will ask for all of it.
  6. Talk to a defense attorney earlyAn attorney can speak to bond conditions, protect evidence and start building the defense before the first court setting.

Bail and bond

How bond works in Texas

A judge or magistrate sets bail to secure a return to court. The common ways to be released are:

  • Cash bond, paid in full to the court
  • Surety bond through a licensed bail bond company, usually for a fee that is not refunded
  • Personal bond, a release on a written promise to appear
Injury claims

After a Houston wreck

Get medical care, photograph the scene and request your Peace Officer's Crash Report (form CR3) through TxDOT. Texas generally allows two years from the date of injury to file a personal injury lawsuit (Tex. Civ. Prac. & Rem. Code §16.003).

Fault

If you were partly at fault

Texas follows a modified comparative fault rule. You can still recover as long as you are not more than 50 percent responsible, and your recovery is reduced by your share of fault (Tex. Civ. Prac. & Rem. Code Chapter 33).

Questions

Frequently asked questions

Do not see your question? Send it with your case review request and we will answer it.

Does it cost anything to use Houston Lawyer Help?

No. There is no charge to you for our referral. Criminal defense fees vary by attorney and charge, and the attorney will explain them before you hire them. Most personal injury attorneys work on a contingency fee, meaning they are paid a percentage of what they recover and nothing if they do not recover.

Are you a law firm?

No. Houston Lawyer Help is a referral service. We do not give legal advice and we do not represent anyone. We connect you with independent attorneys licensed in Texas who make their own decisions about your case.

Can I request help for a family member in jail?

Yes. Many requests come from a parent, spouse or friend. Include the person's full name, the county and the charge if you know it, and mark that they are in custody so we can prioritize the request.

Why is there no phone number?

Online requests let us collect the details an attorney needs, such as the charge, the county and custody status, so your request reaches the right attorney faster. The attorney will call or text you directly.

How long do I have to file an injury claim in Texas?

For most personal injury cases, Texas allows two years from the date of injury to file a lawsuit. Claims against a government entity can require written notice within months, so it helps to act quickly.

Should I talk to the police or an insurance adjuster?

You have the right to decline police questioning and ask for a lawyer. After a wreck, you do not have to give the other driver's insurer a recorded statement. In both situations, speak with an attorney first.
